4. Cookies, advertising and your opt-out choices

We use cookies and pixels to keep your cart working, remember your preferences, measure site traffic and show ads. Some advertising cookies let partners such as [Google Ads, Meta and AdRoll] show you Ruggedyann ads on other websites based on what you viewed here. Under California law this can count as “sharing” personal information for cross-context behavioral advertising, and in some cases as a “sale”.

  • Use the “Do Not Sell or Share My Personal Information” link in our footer.
  • Turn on Global Privacy Control (GPC) in your browser. We honor it as an opt-out for that browser.
  • Use “Cookie Preferences” in our footer to switch off non-essential cookies.
  • Use each partner’s own ad settings or opt-out page: [Google Ads Settings], [Meta Ad Preferences], [AdRoll opt-out].

We respond to GPC rather than “Do Not Track”, which has no common standard. We do not sell or share personal information of anyone we know to be under 16.

  • Delete personal information we collected from you, subject to legal exceptions such as records of a completed order.
  • Correct inaccurate information.
  • Stop selling or sharing your personal information (section 4).

We will not treat you differently for using these rights. We only use sensitive information to provide the services you ask for, so we do not offer a separate “limit” link.

To make a request, email [privacy@ruggedyann.com], call (650) 533-1335 or use [request form link]. We confirm within 10 business days and respond within 45 days. We verify requests by matching details such as your email and a recent order number. An authorized agent may act for you with your signed permission. You can also review or update your details at any time in My Account.

Shine the Light: California residents may ask once a year which third parties received their personal information for those parties’ own direct marketing. We do not share information for that purpose.

7. Email offers and the first-order discount

If you join our email list we may give you [10%] off your first order. This is a financial incentive under California law: you give us your email address and how you engage with our emails, and we estimate that value as roughly equal to the discount, based on our average order value and marketing costs. Joining is optional and you can leave by unsubscribing.

8. Security

All pages are encrypted with SSL/TLS (HTTPS). Card data is handled by our PCI-compliant payment processor and never stored on our servers. Only staff and providers who need customer data can access it. No system is perfectly secure, so please use a strong, unique password.

These Terms & Conditions (“Terms”) apply to your use of ruggedyann.com and any purchase from [Ruggedyann legal entity name] (“Ruggedyann”, “we”, “us”). By using the site or placing an order you agree to these Terms, our Privacy Policy and our Shipping & Returns policy.

1. About Ruggedyann

Ruggedyann is an independent online retailer of Nourison Home rugs and rug pads, including DKNY and Calvin Klein rugs made by Nourison under license. We are [an authorized Nourison retailer] and are not owned by or affiliated with Nourison, DKNY or Calvin Klein in any other way.

2. Who can buy

You must be at least 18, or have a parent or guardian’s permission, and give accurate account, billing and shipping details. Keep your password secure and update your details if they change.

3. Orders and order limits

Your order is an offer to buy. A contract forms when we email your shipping confirmation. We may refuse, limit or cancel any order, including limits per person, household, card or address. We may also decline orders that appear to be placed by dealers, resellers or distributors, as required by our supplier. If we cancel after charging you, we refund you in full.

4. Prices and payment

Prices are in U.S. dollars and may change without notice. Sales tax is added at checkout. Prices, promotions, shipping charges and availability may contain errors. We may correct an error, cancel the order and refund you, even after you have ordered, or contact you to confirm the correct price before shipping. We accept credit and debit cards ([Visa, Mastercard, American Express]).

5. Product information

Product photos, specifications and descriptions are supplied by Nourison. We show them as accurately as we can, but please note:

  • Size: because of how both handmade and machine-made rugs are constructed, actual size may vary slightly from the size listed, by up to about [3 inches or 3%]. “Package dimensions” describe the shipping box.
  • Color: screens show color differently and dye lots vary, so color may differ slightly from the photos.
  • Handmade rugs: small irregularities in shape, pattern and color are part of the craft, not defects.
  • New rugs: wool and jute can shed for the first months; shipping creases and a mild odor fade within days.
  • Nourison may change or discontinue products at any time, so listings can change without notice.

6. Availability and backorders

Most rugs ship from Nourison’s warehouses, and stock is shown as accurately as we can. If a rug becomes unavailable after you order, we will tell you the expected date or offer an alternative, and you may cancel for a full refund.

7. Shipping and delivery

We ship to [the contiguous United States]. Rugs may arrive in separate packages. Delivery dates are estimates. Title and risk of loss pass to you on delivery. Inspect your rug when it arrives and report damage or missing items within [7] days with photos. Details are in our Shipping & Returns policy.

8. Returns and custom orders

Unused rugs in original condition may be returned within [30] days of delivery. [Return shipping is paid by the customer / free.] Custom-size, made-to-order, clearance and final-sale items cannot be returned unless defective. Refunds go to the original payment method within [10] business days after we receive and inspect the return.

9. Rug care and safety

Use a rug pad under every rug to reduce slipping and wear, and follow the care instructions on the product page. Indoor-only rugs are not made for outdoor or wet areas. We are not responsible for damage caused by improper use, cleaning or installation.

10. Warranty

If a rug arrives defective or damaged, tell us within [30] days of delivery and we will repair, replace or refund it at our choice, working with Nourison where needed. [Any Nourison manufacturer warranty also applies.] Nothing in these Terms limits warranties that California or federal law says cannot be excluded.

11. Trademarks and site content

Nourison, Nourison Home, DKNY and Calvin Klein are trademarks of their owners and are used only to identify the products we sell. Product images belong to Nourison. All other site content, including text, design and the Ruggedyann name and logo, belongs to us. You may not copy, sell or reuse any of it without written permission.

12. Reviews and submissions

If you post a review, photo or idea, you confirm it is your own, accurate and lawful, and you give us a free, non-exclusive licence to use it on our site and in marketing. We do not have to keep submissions confidential or pay for them. We may remove content that is unlawful, offensive, misleading or unrelated. We never edit a review to change its meaning.

13. Use of the website

You may not use the site to:

  • break any law or encourage others to do so;
  • infringe our or anyone else’s intellectual property;
  • harass, abuse, defame or discriminate against anyone;
  • submit false information or place fraudulent orders;
  • upload viruses or malicious code;
  • collect other people’s personal information, or spam, phish, scrape or crawl the site;
  • interfere with or get around the site’s security.

We may suspend or end your access if you do.

14. Third-party tools and links

The site may include third-party tools, such as payment, shipment tracking or the “See it in your room” visualizer, and links to other sites such as nourison.com. They are provided as is, under their own terms. We do not control them and are not responsible for their content or practices.

15. Disclaimer and limitation of liability

We do not promise the site will always be available, error-free or secure. To the fullest extent allowed by law, we are not liable for indirect, incidental or consequential losses, such as lost profits or data. Our total liability for any claim is limited to the amount you paid for the product involved. This does not limit liability for personal injury caused by our negligence, fraud, or anything else that cannot be limited by law.

16. Indemnity

You agree to cover our reasonable costs, including legal fees, if a third party brings a claim against us because you broke these Terms or the law.

17. Ending these Terms

You can stop using the site at any time. We may end or suspend your access if you break these Terms. Anything you owe us, and any rights that by their nature should survive, continue after that.

18. Governing law and disputes

These Terms are governed by the laws of the State of California. Disputes will be handled in the state or federal courts in San Mateo County, California, unless the law where you live gives you the right to bring a claim locally. [Optional, lawyer to decide: arbitration clause with class-action waiver and small-claims carve-out.]

19. General

We may update these Terms by posting a new version with a new effective date; the version in effect when you order applies to that order. If any part is unenforceable, the rest still applies. Our failure to enforce a term is not a waiver. These Terms and the policies they mention are the entire agreement between us about the site, and are not read against us because we wrote them.

20. Notice for California residents

Under California Civil Code Section 1789.3, California users are entitled to this notice: the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs can be contacted in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by phone at (916) 445-1254 or (800) 952-5210.
